Minutes for HB2002 - Committee on Taxation

Short Title

Continuing in existence the reimbursement from the taxpayer notification costs fund for printing and postage costs for county clerks beyond calendar year 2023.

Chairperson Smith opened the hearing for HB2002.

Adam Siebers, Assistant Revisor, provided an overview of HB2002 noting the bill removes the upcoming date that would disallow any future reimbursements from the taxpayer notification costs fund (Attachment 1). Mr. Siebers stood for questions from Committee members.

Kathleen Smith, Kansas Department of Revenue, provided an overview of the fiscal note for HB2002 noting the Department of Revenue indicates there will be no fiscal effect on state property tax revenue.  The Taxpayer Notification Costs Fund has received $1,087,971 in tax year 2022 and is estimated to receive $1,190,747. in tax year 2023. Ms. Smith stood for questions from Committee members.

Proponents:

Representative Brett Fairchild testified as a proponent for HB2002 (Attachment 2).  He noted HB2002 would provide a permanent provision for counties to be reimbursed from the State General Fund for the cost of sending out tax notices.  Representative Fairchild stood for questions from Committee members.

Jay Hall, Kansas Association of Counties, testified as a proponent for HB2002  (Attachment 3).  HB2002 would amend existing law by requiring the state to continue to pay for the mandated printing and postage costs to send out tax notices.  Mr. Hall stood for questions from Committee members.

Rick James, former County Commissioner, Linn County testified as a proponent for HB2002 eliminating the state's financial funding places another liability on counties, school districts, and cities who cannot afford it. (Attachment 18)

Michael Kennedy, Resident of Douglas County testified in opposition to HB2002 noting the cost of notifications to taxpayers incurred by the County could be to pro-rate the cost to each taxing subdivision looking to exceed the revenue neutral rate.  (Attachment 17)
