Minutes for HB2084 - Committee on Federal and State Affairs

Short Title

Enacting the kratom consumer protection act, defining kratom as a food product, prohibiting the sale of kratom that is adulterated, requiring persons to be at least 18 years of age for the purchase of such product, establishing civil fines for violations of the act and requiring the secretary of agriculture to adopt rules and regulations for the administration of the act.

Chairperson Carpenter opened the hearing on HB2084.  The revisor provided an overview on the bill (Attachment 1).  Questions were asked by Chairperson Carpenter and Representative Humphries.

Chairperson Carpenter recognized Mac Haddow as a proponent of HB2084 (Attachment 2).  He stated that based on survey research, one-third of kratom consumers consume kratom for an energy boost and increased focus; another one-third use it to reduce anxiety or feelings of depression; and the final one-third use it to manage acute and chronic pain, including to wean off highly addictive and potentially deadly opioids.  The National Institute on Drug Abuse (NIDA) supports accessibility to consumers for kratom because of its harm reduction tools and has opposed the FDA's efforts to have it banned.  they believe kratom should be regulated to keep the product from being corrupted, but it should not be regulated by the FDA.  Questions were asked by Representatives Ruiz, Clayton, Hoye, Miller, Haswood, Humphries, Jacobs, and Howell.  Chairperson Carpenter asked the conferee to provide the letter he referred to in his testimony and the studies that have been conducted. 

Chairperson Carpenter noted that there was written neutral testimony from Kelsey Olson, Kansas Department of Agriculture (Attachment 3), but asked her to approach the Committee for questions, if any.  The conferee stated that she would rely on her written testimony unless there were questions.  There were no questions.

Chairperson Carpenter closed the hearing on HB2084.
