Enacting the no patient left alone act to allow in-person visitation to certain patients at hospitals, adult care homes and hospice facilities.

Rachel Monger, President and CEO, LeadingAge Kansas, provided reluctant testimony in opposition to HB2264 (Attachment 5). While agreeing in substance with the bill there is concern that there could be liability exposure and impact to preserving Medicaid and Medicare funding through compliance with CMS rules and regulations. The resident visitation restrictions addressed in the bill were regulatory requirements for CMS. Failure to comply would have led to thousands of dollars in fines, loss of Medicaid and Medicare funding and possible closures. Ms. Monger proposed three possible amendments to the bill that her organization would feel comfortable supporting the bill.
