Minutes for SB228 - Committee on Judiciary

Short Title

Modernizing statutes concerning county jails, removing the requirement that every county shall have a jail, modifying procedures used when district courts commit prisoners to jail in another county and when counties contract with city jails to keep prisoners and requiring a medical examination before certain United States prisoners or city prisoners are taken into custody of a county jail.

Chairwoman Warren opened hearing on SB228.  Jason Thompson provided an overview of the bill and stood for questions.(Attachment 6)

Sandy Horton, testified in support of SB228. The Kansas Sheriff's Association believes the proposed language updates the statute to current practices, current case law, and the need for immediate medical treatment for the prisoner at the time they are first contacted by law enforcement.(Attachment 7)

Darrell Atteberry, gave testimony in support of SB228.  He stated they want to create clarity in the statute, as there has been some conflict with the intake of prisoners, and when those prisoners need to be cleared by physician or competent medical personnel, before being booked into a jail.  (Attachment 8)

There being no further conferees, the hearing on SB228 was closed.

Meeting Minutes for 2-7 through 2-9 were submitted for review.  The Chairwoman asked if there was a motion to approve the minutes as submitted.  Senator Gossage moved to approve the minutes, Senator Haley seconded the motion.  The motion carried.

Chairwoman Warren adjourned the meeting at 12:06 p.m.
