Minutes for SB228 - Committee on Corrections and Juvenile Justice

Short Title

Modernizing statutes concerning county jails, removing the requirement that every county shall have a jail, modifying procedures used when district courts commit prisoners to jail in another county and when counties contract with city jails to keep prisoners and requiring a medical examination before certain United States prisoners or city prisoners are taken into custody of a county jail.

Chairperson Owens called for discussion and final action on SB228.  Natalie Scott provided a review of the bill.

Representative Eric Smith proposed an amendment that would clarify how bills for inmates are paid.  (Attachment 1)

Representative Eric Smith moved, Representative Schlingensiepen seconded, to adopt the amendment.  Motion carried.

Representative Highberger proposed an amendment that would remove language added by the Senate that would require determination of gender.  (Attachment 2)

Representative Highberger moved, Representative Schlingensiepen seconded, to adopt the amendment.  Motion carried.   Representatives Highberger and Schlingensiepen requested their "Aye" votes be recorded.

Representative  Owens proposed an amendment that would clarify who is considered the arresting agency.  (Attachment 3)

Representative Owens moved, Representative Eric Smith seconded, to adopt the amendment.  Motion carried.

Representative Titus proposed an amendment that would update language to take into account that not every county has a sheriff and not every county jail is operated directly by the county.  (Attachment 4)

Representative Titus moved, Representative Thompson seconded, to adopt the amendment.  Motion carried.

Representative Eric Smith moved, Representative Maughan seconded, to recommend SB228 as amended, favorably for passage.  Motion carried.  Representatives Highberger and Schlingensiepen requested their "Aye" votes be recorded.
