Chairperson Smith opened the hearing for HB2828.

Adam Siebers, Assistant Revisor, provided an overview for HB2828 that provides a countywide retailer's sales tax authority  for Marshall County. Under the bill, Marshall County has the authority to submit a proposition to the electors to impose a countywide retailers' sales tax in an amount up to 1.0 percent and pledging the revenue received for the purpose of financing the costs of constructing or remodeling and furnishing a jail facility. (Attachment 1)  Mr. Siebers stood for questions from Committee members.

Proponent:

Jon L. Ungerer, Marshall County Commissioner, District 1, testified as a proponent for HB2828 stating the current Marshall County jail was constructed in 1979 that is a two-story brick building and as it stands now the jail cannot meet modern jail standards as they relate to classifying inmates for housing.  A plan for a new jail was designed and the estimated cost was $13.5 million.  Mr. Ungerer noted the county is exploring options to construct a new jail facility which would cut the cost by approximately 40.0 percent.  The county commissioners would like the option of pursuing funding methods which could include a sales tax for reduced costs going on the ballot without the need to go to each county municipality to approve interlocal agreements.  (Attachment 2), (Attachment 3), (Attachment 4), (Attachment 5)  Mr. Ungerer stood for questions from Committee members.

Chairperson Smith stated Sheriff Timothy Ackerman, Marshall County is in the audience to answer any questions regarding HB2828.
