Minutes for HB2813 - Committee on Federal and State Affairs

Short Title

Creating the crime of coercion to obtain an abortion and providing enhanced criminal penalties for offenses committed with the intent to coerce a woman to obtain an abortion.

The Chair opened discussion on HB2813.  The Revisor provided an overview of the bill.

Representative Hoye moved to amend HB2813, seconded by Representative Clayton (Attachment 1)

Representative Hoye stated that this amendment goes further than just coercion concerning abortion.  There are other reproductive coercion circumstances that should be included.  This amendment would broaden the definition by striking the word "abortion" and changing it to "reproductive coercion."  It would include a person who is trying to force someone to take birth control or interfering with someone's access to contraceptives.  

Discussion ensued.  Representative Hoye then closed on her motion to amend.

The motion to amend HB2813 was favorably passed.

Representative Haswood moved to amend HB2813, seconded by Representative Hoye (Attachment 2).

Representative Haswood stated this amendment broadens the measure by deleting the words "the father or the putative father" and making it "an intimate partner or former intimate partner."

Discussion ensued.

Representative Haswood agreed to a friendly amendment to add the words "the father or the putative father" back into the amendment.

Further discussion ensued.

Representative Haswood closed on her motion.  An oral vote was taken, and the Chair stated he was in doubt.  A vote was taken by a raising of hands.  The motion to amend failed to pass by a vote of 7 in favor and 13 in opposition.

Representative Howell moved to reconsider the Hoye amendment, seconded by Representative Thomas.

Discussion ensued.

Representative Thomas called the question.

A vote was taken on the motion to reconsider.  The motion to reconsider was passed.

Chairperson Carpenter stated that the original motion to amend by Representative Hoye is up for discussion.

Representative Hoye made a substitute motion to amend HB2813 as previously presented, and to add "reproductive coercion or abortion coercion" in lines 1 and 2 and to leave in lines 24 and 25 on page one and lines 17 and 18 on page 2, seconded by Representative Ruiz.  

Discussion ensued. 

A vote on the substitute motion was taken.  The Chair was in doubt.  A vote by a raising of hands was taken.  There were 11 ayes and 9 nos.  The substitute motion to amend HB2813 was passed.

The following representatives asked to have their yes votes recorded:  Representatives Highberger, Sanders, Miller, Haskins, Hoye, Ruiz, Eplee, and Clayton.

The Chair stated that they were back on the bill, as amended.

A vote was taken.  HB2813, as amended, was favorably passed.
