\"Sec34:OnandafterJanuary26,2021,KSA2019Supp.48-925,asamendedbysection33ofthisact,isherebyamendedtoreadasfollows:48-925.(a)DuringanystateofdisasteremergencydeclaredunderKSA48-924,andamendmentsthereto,thegovernorshallbecommander-in-chiefoftheorganizedandunorganizedmilitiaandofallotherforcesavailableforemergencyduty.Tothegreatestextentpracticable,thegovernorshalldelegateorassigncommandauthoritybypriorarrangement,embodiedinappropriateexecutiveordersorinrulesandregulationsoftheadjutantgeneral,butnothinghereinshallrestricttheauthorityofthegovernortodosobyordersissuedatthetimeofadisaster.\\r\\n(b)\\u2003Undertheprovisionsofthisactandfortheimplementationofthisactthereof,thegovernormayissueorderstoexercisethepowersconferredbysubsection(c)thatandproclamationswhichshallhavetheforceandeffectoflawduringtheperiodofastateofdisasteremergencydeclaredundersubsection(b)ofKSA48-924(b),andamendmentsthereto,orasprovidedinsection5,andamendmentsthereto.Within24hoursoftheissuanceofanysuchorder,thegovernorshallcallameetingofthestatefinancecouncilforthepurposesofreviewingsuchorder.Such,andwhichordersandproclamationsshallbenullandvoidaftertheperiodofastateofdisasteremergencyhasendedthereafterunlessratifiedbyconcurrentresolutionofthelegislature.Suchordersandproclamationsmayberevokedatanytimebyconcurrentresolutionofthelegislature.\\r\\n(c)\\u2003DuringastateofdisasteremergencydeclaredunderKSA48-924,andamendmentsthereto,andinadditiontoanyotherpowersconferreduponthegovernorbylawandsubjecttotheprovisionsofsubsections(d),(e)and(f),thegovernormay:\\r\\n(1)\\u2003Suspendtheprovisionsofanyregulatorystatuteprescribingtheproceduresforconductofstatebusiness,ortheordersorrulesandregulationsofanystateagencywhichimplementssuchstatute,ifstrictcompliancewiththeprovisionsofsuchstatute,orderorruleandregulationwouldprevent,hinderordelayinanywaynecessaryactionincopingwiththedisaster;\\r\\n(2)\\u2003utilizeallavailableresourcesofthestategovernmentandofeachpoliticalsubdivisionasreasonablynecessarytocopewiththedisaster;\\r\\n(3)\\u2003transferthesupervision,personnelorfunctionsofstatedepartmentsandagenciesorunitsthereofforthepurposeofperformingorfacilitatingemergencymanagementactivities;\\r\\n(4)\\u2003subjecttoanyapplicablerequirementsforcompensationunderKSA48-933,andamendmentsthereto,commandeerorutilizeanyprivatepropertyifthegovernorfindssuchactionnecessarytocopewiththedisaster;\\r\\n(5)\\u2003directandcompeltheevacuationofallorpartofthepopulationfromanyareaofthestatestrickenorthreatenedbyadisaster,ifthegovernordeemsthisactionnecessaryforthepreservationoflifeorotherdisastermitigation,responseorrecovery;\\r\\n(6)\\u2003prescriberoutes,modesoftransportationanddestinationsinconnectionwithsuchevacuation;\\r\\n(7)\\u2003controlingressandegressofpersonsandanimalstoandfromadisasterarea,themovementofpersonsandanimalswithintheareaandtheoccupancybypersonsandanimalsofpremisestherein;\\r\\n(8)\\u2003suspendorlimitthesale,dispensingortransportationofalcoholicbeverages,explosivesandcombustibles;\\r\\n(9)\\u2003makeprovisionfortheavailabilityanduseoftemporaryemergencyhousing;\\r\\n(10)\\u2003requireanddirectthecooperationandassistanceofstateandlocalgovernmentalagenciesandofficials;and\\r\\n(11)\\u2003performandexercisesuchotherfunctions,powersanddutiesinconformitywiththeconstitutionandthebillofrightsofthestateofKansasandwiththestatutesofthestateofKansas,exceptanyregulatorystatutespecificallysuspendedundertheauthorityofsubsection(c)(1),asarenecessarytopromoteandsecurethesafetyandprotectionofthecivilianpopulation.\\r\\n(d)\\u2003Thegovernorshallnothavethepowerorauthoritytotemporarilyorpermanentlyseize,orauthorizeseizureof,anyammunitionortosuspendorlimitthesale,dispensingortransportationoffirearmsorammunitionpursuanttosubsection(c)(8)oranyotherexecutiveauthority.\\r\\n(e)\\u2003Notwithstandinganyprovisionofthissectiontothecontraryandpursuanttothegovernor'sstateofdisasteremergencyproclamationissuedonMay26,2020,thegovernorshallnothavethepowerorauthoritytorestrictbusinessesfromoperatingortorestrictthemovementorgatheringofindividuals.TheprovisionsofthissubsectionshallexpireonSeptember15,2020.\\r\\n(f)\\u2003ThegovernorshallnothavethepowerundertheprovisionsoftheKansasemergencymanagementactortheprovisionsofanyotherlawtoalterormodifyanyprovisionsoftheelectionlawsofthestateincluding,butnotlimitedto,themethodbywhichelectionsareconductedorthetimingofsuchelections.\\r\\n(g)\\u2003Thegovernorshallexercisethepowersconferredbysubsection(c)byissuanceofordersundersubsection(b).Eachorderissuedpursuanttotheauthoritygrantedbysubsection(b)shallspecifytheprovisionorprovisionsofsubsection(c)byspecificreferencetoeachparagraphofsubsection(c)thatconfersthepowerunderwhichtheorderwasissued.Theadjutantgeneral,subjecttothedirectionofthegovernor,shalladministersuchorders.\\r\\n(h)\\u2003Theboardofcountycommissionersofanycountymayissueanorderrelatingtopublichealththatincludesprovisionsthatarelessstringentthantheprovisionsofanexecutiveordereffectivestatewideissuedbythegovernor.Anyboardofcountycommissionersissuingsuchanordermustmakethefollowingfindingsandincludesuchfindingsintheorder:\\r\\n(1)\\u2003Theboardhasconsultedwiththelocalhealthofficerorotherlocalhealthofficialsregardingthegovernor'sexecutiveorder;\\r\\n(2)\\u2003followingsuchconsultation,implementationofthefullscopeoftheofprovisionsinthegovernor'sexecutiveorderarenotnecessarytoprotectthepublichealthandsafetyofthecounty;and\\r\\n(3)\\u2003allotherrelevantfindingstosupporttheboard'sdecision.\\r\\n\":
