Short Title

Making permanent provisions for the advisory committee on trauma and the statewide trauma system regional council to conduct closed meetings and keep privileged records regarding trauma cases.

Scott Abbott, Revisor of Statutes, provided and overview of SB170 to the committee.

Wendy O'Hare, Trauma Program Director, Kansas Department of Health and Environment, provided testimony in support of SB170. The Advisory Council on Trauma is essential to KDHE to protect and improve the health and environment of all Kansans. The bill removes the sunset clause created when the Council was created regarding protection from disclosure of healthcare providers during regional performance improvement meeting being provided through the Open Records statute. A brief description of the process of the Advisory Council was provided to the committee (Attachment 1).

Joseph House, Executive Director, Emergency Medical Services Board, provided testimony in support of SB170. Without the provision to review cases in a closed session, the ability of the system to adapt from potential mistakes made and the successes achieved would be significantly inhibited. SB170 makes the provisions permanent. The Board supports the passage of the bill (Attachment 2).

Chairman Landwehr motioned and Representative Barker seconded that the effective date should be changed from publication in the statute book to publication in the register. Motion carried.

Representative Parker motioned and Representative Kelly seconded to advance SB170 as amended favorably. Motion carried.
